Overview
Lisa Marks is an experienced trial lawyer and advocate representing clients in a variety of civil and complex commercial cases, including class actions. Well-versed in all aspects of case management, analysis, discovery, expert development, motion practice, trial preparation, and court proceedings, Lisa has litigated in state and Federal courts in multiple jurisdictions, including Colorado, California, Illinois, and Missouri, as well as in private and FINRA (financial industry) arbitrations.
Lisa focuses her practice and helps clients involved in business and civil disputes. She has handled claims involving breach of contract, breach of fiduciary duty, fraud, civil theft, tortious conduct, statutory violations, shareholder oppression, trade secret violations, infringement on intellectual property, construction defects, and real property disputes.
Prior to joining Welborn, Lisa worked in law firms located in Colorado and Illinois, practicing commercial and business litigation. Early in her career, Lisa served as a law clerk for the Honorable William F. Dressel (Retired) in Colorado’s Eighth Judicial District, assisting the judge with his court docket, including jury trials, writing legal memoranda, and drafting opinions for the court.
Experience & Results
- Following a trial to the Court, obtained a $2.78 million judgment in favor of plaintiff Homeowners’ Association on claims for civil theft, breach of fiduciary duty, and breach of contract against a property manager.
- Following a five-day jury trial, obtained a verdict for plaintiff on a breach of contract claim arising from the defendant’s failure to pay developer fees. Secured judgments totaling more than $775,000 and successfully defended a counterclaim seeking approximately
$1 million. - Following a five-day FINRA arbitration trial, obtained a $805,120 award in favor of plaintiffs against defendant bank and its investment broker in a financial fraud case.
- Following a five-day jury trial, successfully defended a Colorado business in a breach of contract case.
- Obtained a multi-million-dollar settlement in favor of a municipality plaintiff during a jury trial involving the defective design of a wastewater treatment facility.
- Obtained a multi-million-dollar settlement in favor of plaintiff after a Court’s directed verdict on liability and causation due to discovery violations by the defendant in a toxic lead exposure case.
- Successfully obtained class certification and represented physician plaintiffs in a class action against defendant health system on claims for breach of contract and fraud pertaining to work Relative Value Unit (RVU) productivity bonus compensation.
- Achieved a favorable settlement for an individual defendant during a five-day jury trial involving a real property dispute.
- Prevailed on summary judgment on behalf of commercial tenants against a landlord in a shopping center lease and property repair dispute.
- Successfully defended a nonprofit corporation during motion practice and obtained complete dismissal of breach of trust and breach of fiduciary duty action.
