Overview

David is a creative litigator who represents clients in a wide array of complex civil matters. He has appeared before state and federal courts, as well as arbitration tribunals, and his clients have ranged from individuals to multinational corporations. David is also a tactful negotiator, having secured many decidedly favorable settlements for both plaintiffs and defendants.

After graduating from the University of Colorado Law School, David began his practice in New York before making a return to the mountains.

Experience & Results
  • Briefed successful motion for summary judgment dismissing claims of quiet title, breach of contract, tortious interference with contract, civil conspiracy, unjust enrichment, and constructive fraud totaling more than $40 million. Additional details here.
  • Represented non-operator plaintiffs in a 2-month jury trial in California concerning an oil and gas dispute, prevailing on claims to remove the lease operator and on breach of contract.
  • Secured dismissal of claims against oil and gas company for civil conspiracy, fraud, and tortious interference with contract.
  • Obtained a favorable result in a lawsuit brought on behalf of an oil and gas producer against midstream marketers for breach of contract, declaratory judgment, and conversion.
  • Defended various entities against claims for breaches of the Americans with Disabilities Act and New York Human Rights Law brought by serial plaintiffs.
  • Brought suit for trademark infringement in the Southern District of New York against well known celebrity and international tech company.  The alleged infringers no longer use the contested mark.
  • File trademark applications with the USPTO and advise clients concerning trademark matters.
